  1. Collection, Processing and Use of Personal Data

The provision of your personal data takes place voluntarily within the framework of the conclusion and existence of the contractual relationship and agreement with Masterpiece. Among others, it is required that you provide personal data of special categories. If you do not want Masterpiece to process your personal data or in particular, data from special categories, Masterpiece cannot provide its services to you. Which data Masterpiece collects in detail can be found in the following explanations.

What data does Masterpiece collect from its members?

To provide services, described in more detail in its Terms by Masterpiece, it is necessary to collect personal data that the user (also referred to as Masterpiece member) provides, among other things, as part of the registration process, the completion of a basic membership or a premium membership, to process and to use.

Registration process and completion of basic membership

When initially registering free of charge (completion of the so-called “basic membership”), the user (or “basic member”) is asked to provide certain minimum information without which the registration cannot be completed. The mandatory data is:

Masterpiece is accessed via the email address provided by the user and the password selected by them (so-called access data).

In addition, Masterpiece needs further information from its users to provide its services, such as personal pictures, preferences, personal values, appearance, and other characteristics relevant to the partner presentation, which serve as the basis for creating the Masterpiece profile. In this context, we also ask you about your religion. The information is voluntary. In this respect, Masterpiece requests separate consent. You have the right to object to the storage of information at any time. Free text information about each person who is a Masterpiece member and pictures of the Masterpiece member can also be stored in a profile.

All data of the Masterpiece profile can be visible on the website and app for other registered users in the member’s area of Masterpiece. Also visible is data that the user releases to other users, including age, interests, personal messages, etc.

When registering via (“Email login”)

Masterpiece offers you the opportunity to register via your Email account. If you make use of this, we will receive the data required for registration from Email. When registering via phone number (“Cell phone login”)

Masterpiece offers the option of specifying the cell phone number for a so-called cell phone login. People can sign up using their cell phone number. To fully function, the users have to agree to receive text messages (SMS) from Masterpiece. A confirmation code will be sent to the cell phone number they use after the user has given consent.

Masterpiece may send to this phone number important messages regarding the user’s Masterpiece account and its promotions and services. Masterpiece will not share this phone number with any third party.

If a user does not want to sign-up with his cell phone number, he should choose a different sign-up method on the Masterpiece app or website onMasterpiece.com.

When registering via Google (“Google login”)

Masterpiece offers you the opportunity to register via your Google account. If you make use of this, we will receive the data required for registration from Google. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Google using the Google login. If you do not want Google to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Google login.

When registering via LinkedIn (“LinkedIn login”)

Masterpiece offers you the opportunity to register via your LinkedIn account. If you make use of this, we will receive the data required for registration from LinkedIn. In this respect, data is transmitted.

We have no influence on the scope of the data collected by LinkedIn using the LinkedIn login. If you do not want LinkedIn to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the LinkedIn login.

When registering via Apple (“Apple login”)

You can register on Masterpiece by using your Apple ID account. If you make use of this, we will receive the data required for registration from Apple. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Apple using the opportunity to sign-in with Apple. If you do not want Apple to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Apple login. Purchase of a Premium Membership

If the user (hereinafter also referred to as “Premium Member”) decides to use a paid service from Masterpiece (so-called “Premium Membership”), the following information is collected:

This data, including credit card data is stored by the payment provider and not by Masterpiece:

  • name and first name
  • residential address
  • payment and billing data

And additionally:

  • Communication with members and customer service

Masterpiece does not store the communication between members but might save communication with the Masterpiece customer service. Communication between members when logged in is encrypted.

What data does Masterpiece collect for advertising purposes?

After completing the free basic membership, enter your email address in the input mask. This email address will then be used to send promotional emails for the free and paid products of Masterpiece Limited without your consent. You have the option at any time to object to the use of your email address for advertising purposes. On the Masterpiece website and app, you can also subscribe to a free newsletter by clicking on a checkbox. When registering for the newsletter, the data from the input mask is used. Again, you can object to the use of your email address for receiving newsletters at any time. You will also receive personalized or individualized guides during the Masterpiece membership, which should enable you to make the best use of the Masterpiece products. What data does Masterpiece collect when using the Masterpiece website or mobile application?

Each time the Masterpiece website or app is accessed, usage data of the respective website visitor – unless otherwise stated below, even if it is not a Masterpiece member – is transmitted by the respective Internet browser and stored in log files, so-called server log files. This data is:

  • Information about the browser type and the internet service provider of the user as well as the operating system used (e.g. Windows 7, Apple OS, etc.)
  • IP address (Internet protocol address) of the accessing computer, tablet or smartphone (the IP address is compared with a geo database and the origin or country, state and city of the user is determined.)
  • User identification on the Masterpiece platform (only from Masterpiece members)
  • Name of the page accessed.
  • Date and time of access
  • the referrer URL (origin URL) from which the user came to the accessed page
  • The iOS apps access your current data copied to the clipboard, but Masterpiece does not store or read it
  • Amount of data transferred.

The following usage data is stored in the so-called login data records every time the Masterpiece member logs into his Masterpiece profile:

  1. Data Processing Purposes

Masterpiece processes the personal data of its users for the following purposes:

  • •To perform the services described in the Masterpiene general terms and conditions. (The legal basis for the data collection is the fulfillment of the contractual relationship concluded with you as a Masterpiece member. Please note that we also collect data on the sexual orientation “Gender and sought gender”).
  • •Prevention and defense against abuse. Masterpiece uses geo data and personal data that are collected in connection with your registration, and the Masterpiece profile, for an automated check whether there are indications of misuse of the Masterpiece website. The data is stored in a database under a pseudonym and compared with empirical values. If the automated processing reveals suspicion of abuse, a Masterpiece employee checks the evaluation and the underlying clues as well as the free text information and the stored profile photos. A customer service representative also reviews reported breaches of contract by other members. Masterpiece also uses the voluntary process of profile picture verification. Therefore, the user uploads a real time selfie with the front camera of the device. This verification picture will only be used for identity verification purposes. Further, Masterpiece allows voluntarily income verification on its website. The Masterpiece member can upload an official identification together with an official statement that proves his income. These two documents are only used to determine the actual income of a Masterpiece member, and are deleted straight after the process is completed and won’t be stored furthermore or shared with any third party.
  • •For automated price determination. (The legal basis is the fulfillment of the contractual relationship.)
  • •To secure your remuneration obligations from the contractual relationship in the event of default. (In addition to fulfilling the contractual relationship, the legal basis is also Masterpiece’s legitimate interest in paying the contractually agreed remuneration.
  • •For the functionality of the website, for the optimization and analysis of the website and for ensuring the security of the information technology systems of Masterpiece. In this context, Masterpiece uses technically necessary and unnecessary cookies or analysis cookies. (The legal basis is the legitimate interest of Masterpiece and the Masterpiece members that the Masterpiece service can be used safely and easily, and that the quality of our website and the content is constantly improved.)
  • •For recording and evaluating usage behavior for interest-based advertising (only Masterpiece products). We also share tracking data with third parties (e.g. Google and Facebook) to measure the success of these advertising campaigns (so-called conversion tracking). We may update this Privacy Policy from time to time. We will place any updates to this policy on our website. You are bound by any changes to the Privacy Policy by using the Masterpiece Services after such changes have been posted to the website.

Masterpiece will only give your personal data to third parties if this is necessary to fulfill the contract or if you have given your consent. If personal data is transmitted to third parties on the basis of a legitimate interest, we explain our legitimate interest in these data protection provisions.

In addition, personal data can be transmitted to third parties if Masterpiece should be obliged to do so by law or by enforceable administrative or judicial order.

Service Providers

Masterpiece reserves the right to use service providers when collecting or processing personal data. Service providers receive from Masterpiece only the personal data that they need for their specific activity.

Masterpiece works with affiliate businesses who commercially help executing Masterpiece and its services. While they are entitled to collect your data, it is saved and remains with Masterpiece Limited. Affiliates don’t save or share your personal data.

Masterpiece uses, among other things, service providers for sending emails and newsletters to their members. Service providers also provide the Masterpiece server capacity. External payment services and service providers in connection with debt collection support Masterpiece in processing payments. Depending on which payment method you select in the ordering process, Masterpiece passes on the data collected to process payments (e.g. bank details or credit card details) to the credit institution commissioned with the payment or to payment service providers commissioned by Masterpiece. In some cases, the payment service providers collect this data themselves. In this respect, the data protection declaration of the respective payment service provider applies.

Service providers are usually involved as so-called processors, who are only allowed to process personal data of the users of this online offer following instructions from Masterpiece.

  1. Duration of Data Storage; Storage periods

We store your data for as long as is necessary to provide our online services (basic membership / premium membership) and the associated services or we have a legitimate interest in further storage. In all other cases, we delete your personal data with the exception of data that we must keep in order to meet contractual or legal (e.g. tax or commercial) retention periods (e.g. invoices).

The following applies to basic members: You can revoke the storage of the personal data contained in your profile at any time with future effect. You can also delete your profile data yourself. Masterpiece automatically deletes personal profile data from basic members who are inactive for 24 months.

The following applies to premium members: The personal data of Masterpiece premium members is generally stored for the duration of the contractual relationship. If you ask us to do so, we will delete your data, provided that there is no legal retention requirement for this data. We block data that is subject to a retention period until the retention period expires. If you do not ask us to delete your data by the end of the premium membership, your premium membership will become a basic membership. The information given above regarding the duration of the storage of basic member data then applies.

Please note that your data will initially only be blocked if the deletion is contrary to retention periods.

As part of the assertion of data subject rights, Masterpiece stores the data that is necessary for the fulfillment or proof during the limitation period.

This online service uses cookies. In addition to the description of the individual cookies, we have also listed the purpose of use and other important information at this point.

Use of Google Ads Conversion Tracking

Masterpiece uses the online advertising program “Google Ads” and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). If you click on an advertisement placed by Google, a cookie for the conversion tracking is placed on your computer. These cookies lose their validity after 90 days. Use of Google Ads Remarketing Function

Masterpiece uses the online advertising program “Google Ads” and in this context conversion tracking (visit campaign evaluation). Google Conversion Tracking is an analysis service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Using this function, Masterpiece can target visitors to the website with advertising by displaying personalized, interest-based advertisements for visitors of Masterpiece when they visit other websites in the Google display network or use the search function of Google or a partner. Google uses cookies to carry out the analysis of website use, which forms the basis for the creation of interest-based advertising. To do this, Google stores a small file with a sequence of numbers in the browsers of Masterpiece users. This sequence of numbers records the visits by Masterpiece and data on the use of Masterpiece. If users subsequently visit other websites in the Google display network or the search function of Google or a partner, Masterpiece visitors will see advertisements that are highly likely to take account of previously accessed product and information areas.

Use of Facebook Custom Audiences

Masterpiece wants to present “interest-based advertising” on Facebook and limit the frequency with which certain advertisements are displayed. For this purpose, Masterpiece uses the website custom audiences’ tool from Facebook and the Facebook pixel. The Facebook pixel is a Javascript code that sends the following data to Facebook Ireland Ltd, Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland (“Facebook”):

HTTP header information (including IP address, information about the web browser, page storage location, document, URL of the website or the respectively accessed page and user agent of the web browser as well as day and time of use).

Events (the user’s website visit to Masterpiece, registration, purchasing). Pixel-specific data; this includes the pixel ID and Facebook cookie data, including your Facebook ID (these are used to link events to a specific Facebook advertising account and to associate them with a Facebook user).

Facebook uses the hashed user-specific Facebook ID (contained in the Facebook cookie) to automatically check whether the data transmitted by the Facebook pixel can be assigned to a Facebook user. If no Facebook cookie is stored in your browser, no classification into one of the “Custom Audience” user groups is made.

if the Facebook ID contained in the Facebook cookie can be assigned to a Facebook user, Facebook will assign this user to a “custom audience” based on the rules we have defined, provided the criteria applicable to this are met. We use the information received in this way to display ads on Facebook (“Facebook Ads”). However, ads are only displayed from a “Custom Audience” size of 20 different users – so no conclusions can be drawn about the properties of the individual users from the placement of the ads. The assignment to a “Custom Audience” takes place for a maximum of 180 days. This period starts again when you visit our website again and there is a conformity with the same “Custom Audience” rules.

Facebook can assign your visit to our website and your related activities to your Facebook user account. We cannot do this. We only receive statistical information from Facebook about the use of our website through Audience Insights.

Social Plugins

The integration of social plugins invariably leads to the providers of the plugins storing cookies.

To increase the protection of your data when visiting our online platform, the plugins can be integrated into the page.

Only when you activate the plugins will your internet browser or app establish a direct connection to the servers of the respective plugin provider.
