You can find information on what personal data Masterpiece collects, how we handle this data and what decision options you as a user have. Masterpiece Fine Art LLC, a Delaware limited liability company, is responsible for data processing.

2. Collection, Processing and Use of Personal Data

The provision of your personal data takes place voluntarily within the framework of the conclusion and existence of the contractual relationship and agreement with Masterpiece Fine Art. Which data Masterpiece collects in detail can be found in the following explanations.

What data does Masterpiece collect from its members?

To provide services, described in more detail in its Terms by Masterpiece Fine Art LLC, it is necessary to collect personal data that the user (also referred to as Masterpiece member) provides, among other things, as part of the registration process, the completion of a basic membership or a premium membership, to process and to use.

Registration process and completion of basic membership

When initially registering free of charge (completion of the so-called “basic membership”), the user (or “basic member”) is asked to provide certain minimum information without which the registration cannot be completed. The mandatory data is:

• E-mail address
• Password

Furthermore, further information, such as

• Name
• Username / display name
• User category ( artist, collector, gallery, dealer, investor, or advisor )
• Profile picture
• Phone number ( optional )

can be specified.

When a member submits a request (buy art, sell art or artist application), the member may also provide:

• Information about the artwork (artist, title, medium, dimensions, condition, year)
• Images of the artwork
• Documents such as certificates of authenticity and condition reports
• Provenance history
• Prices, budget and currency
• Country and location of the artwork

Masterpiece Fine Art is accessed via the email address provided by the user and the password selected by them (so-called access data), or via Google, Facebook or Apple login.

In addition, Masterpiece Fine Art stores the requests, submissions, private offers and messages that a member sends through the platform, so that the advisory team can process them. Masterpiece Fine Art does not ask for and does not collect information about sexual orientation, religion, gender or partner preferences.

Marketplace listings show artwork details only, never the owner’s name or contact information. Documents, valuations, prices, provenance, certificates and signed agreements are visible only to the member and to the Masterpiece Fine Art advisory team handling the file.

When registering via email (“Email login”)

Masterpiece Fine Art offers you the opportunity to register with your email address and a password. You can view and change your email address in the settings of your account.

When registering via Google (“Google login”)

Masterpiece Fine Art offers you the opportunity to register via your Google account. If you make use of this, we will receive the data required for registration from Google. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Google using the Google login. If you do not want Google to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Google login.

When registering via Facebook (“Facebook login”)

Masterpiece Fine Art offers you the opportunity to register via your Facebook account. If you make use of this, we will receive the data required for registration from Facebook. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Facebook using the Facebook login. If you do not want Facebook to collect data about you in connection with your use of our online services and use it for its own purposes, you should not use the Facebook login.

When registering via Apple (“Apple login”)

You can register on Masterpiece Fine Art by using your Apple ID account. If you make use of this, we will receive the data required for registration from Apple. In this respect, data is transmitted.

We have no influence on the scope of the data collected by Apple using the opportunity to sign-in with Apple. If you do not want Apple to collect data about you in connection with your use of our online services and use it for your own purposes, you should not use the Apple login. Purchase of a Paid Membership

Paid memberships (Platinum and Premium) are purchased through the Apple App Store or Google Play. Apple and Google process the payment and store your payment and credit card data; Masterpiece Fine Art does not receive or store it. Masterpiece Fine Art only receives the confirmation of the subscription status and plan.

For artworks bought or sold through the platform, Masterpiece Fine Art may ask for the information needed to complete the transaction, such as name, address and invoicing details. Payment arrangements for artworks are coordinated privately with our advisory team.

Communication with customer service

Masterpiece Fine Art stores the communication between members and the Masterpiece Fine Art advisory team and customer service, in order to process requests and provide its services.

What data does Masterpiece Fine Art LLC collect for advertising purposes?

After completing the free basic membership, enter your email address in the input mask. With your consent, this email address will then be used to send promotional emails for the free and paid products of Masterpiece Fine Art. You have the option at any time to object to the use of your email address for advertising purposes. On the Masterpiece Fine Art LLC website and app, you can also subscribe to a free newsletter by clicking on a checkbox. When registering for the newsletter, the data from the input mask is used. Again, you can object to the use of your email address for receiving newsletters at any time. You will also receive personalized or individualized guides during the Masterpiece Fine Art membership, which should enable you to make the best use of the Masterpiece Fine Art products. What data does Masterpiece collect when using the Masterpiece Fine Art LLC website or mobile application?

Each time the Masterpiece website or app is accessed, usage data of the respective website visitor – unless otherwise stated below, even if it is not a Masterpiece Fine Art member – is transmitted by the respective Internet browser and stored in log files, so-called server log files. This data is:

• Information about the browser type and the internet service provider of the user as well as the operating system used (e.g. Windows 7, Apple IOS, etc.)
• IP address (Internet protocol address) of the accessing computer, tablet or smartphone (the IP address is compared with a geo database and the origin or country, state and city of the user is determined.)
• User identification on the Masterpiece Fine Art platform (only from Masterpiece Fine Art members)
• Name of the page accessed.
• Date and time of access
• the referrer URL (origin URL) from which the user came to the accessed page
• The iOS apps access your current data copied to the clipboard, but Masterpiece Fine Art does not store or read it
• Amount of data transferred.
• Status message about whether the retrieval was successful.
• Session identification number
• Screen resolution used.

The following usage data is stored in the so-called login data records every time the Masterpiece member logs into his Masterpiece profile:

• Date and time of login
• User identification on the Masterpiece Fine Art platform
• IP address (Internet protocol address)
• Session cookies number
• Session identification number

3. Data Processing Purposes

Masterpiece processes the personal data of its users for the following purposes:

• •To perform the services described in the Masterpiece Fine Art LLC general terms and conditions. (The legal basis for the data collection is the fulfillment of the contractual membership concluded with you as a Masterpiece Fine Art member). 
• • Prevention and defense against abuse. Masterpiece Fine Art may check registrations, profiles and submissions for indications of misuse of the platform. A customer service representative also reviews reported breaches of the Terms of Use by other members.
• • To review and process art requests, sell requests and artist applications, and to provide art advisory services. (The legal basis is the fulfillment of the contractual relationship.)
• •For the functionality of the website, for the optimization and analysis of the website and for ensuring the security of the information technology systems of Masterpiece. In this context, Masterpiece uses technically necessary and unnecessary cookies or analysis cookies. (The legal basis is the legitimate interest of Masterpiece Fine Art LLC and the Masterpiece members that the Masterpiece service can be used safely and easily, and that the quality of our website and the content is constantly improved.)
• •For recording and evaluating usage behavior for interest-based advertising (only Masterpiece products). We also share tracking data with third parties (e.g. Google and Facebook) to measure the success of these advertising campaigns (so-called conversion tracking). You can find out more under the heading Web analysis. (The legal basis is the legitimate interest of Masterpiece Fine Art and other advertisers to play interest-based advertising and to offer users advertising that is tailored to their personal interests.)
• •For the integration of social plugins and social share functions. (Legal basis is the legitimate interest of Masterpiece Fine Art, wish of users who have activated a social plugin to share their information with the corresponding social network.)
• •For sending newsletters and promotional emails about the products of Masterpiece Fine Art LLC, if you have consented to receive them.
• •For market research and range measurement. (The legal basis is Masterpiece’s legitimate interest in gaining knowledge of the market value of the Masterpiece Fine Art website in direct comparison with third-party websites. The legitimate interest also arises from the commercial usability of the knowledge gained from the range measurement. In this context, user categories are also formed. The user categories form the basis for an interest-oriented alignment of advertising materials or advertising measures.)

4. Legal basis for the processing of personal data

Insofar as we obtain the data subject’s consent for processing personal data, Art. 6 Para. 1 lit. A of the EU General Data Protection Regulation (GDPR) as the legal basis. When processing personal data that is necessary to fulfill the contractual relationship of Masterpiece Fine Art (basic membership or a premium membership), Art. 6 para. 1 lit. B of the GDPR as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.

If processing is necessary to safeguard a legitimate interest of Masterpiece or a third party, such as its members, and if the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest, Art. 6 para. 1 lit. F of the GDPR as the legal basis for processing.

5. Disclosure of Data to Third Parties; Service Providers

Masterpiece Fine Art will only give your personal data to third parties if this is necessary to fulfill the contract or if you have given your consent. If personal data is transmitted to third parties on the basis of a legitimate interest, we explain our legitimate interest in these data protection provisions.

In addition, personal data can be transmitted to third parties if Masterpiece Fine Art should be obliged to do so by law or by enforceable administrative or judicial order.

Service Providers

Masterpiece reserves the right to use service providers when collecting or processing personal data. Service providers receive from Masterpiece Fine Art only the personal data that they need for their specific activity.

Masterpiece Fine Art uses in particular the following service providers:
Google Firebase: authentication, database and file storage
Apple and Google: processing of subscription payments
Our hosting provider: website and server capacity
Email service providers: sending transactional emails and newsletters

Your personal data remains with Masterpiece Fine Art LLC. Masterpiece Fine Art does not sell, trade or share your personal data with third parties for their own marketing purposes.

Service providers are usually involved as so-called processors, who are only allowed to process personal data of the users of this online offer following instructions from Masterpiece.

6. Duration of Data Storage; Storage periods

We store your data for as long as is necessary to provide our online services (basic membership / premium membership) and the associated services or we have a legitimate interest in further storage. In all other cases, we delete your personal data with the exception of data that we must keep in order to meet contractual or legal (e.g. tax or commercial) retention periods (e.g. invoices).

The following applies to basic members: You can revoke the storage of the personal data contained in your profile at any time with future effect. You can also delete your profile data yourself. Masterpiece automatically deletes personal profile data from basic members who are inactive for 24 months.

The following applies to premium members: The personal data of Masterpiece premium members is generally stored for the duration of the contractual relationship. If you ask us to do so, we will delete your data, provided that there is no legal retention requirement for this data. We block data that is subject to a retention period until the retention period expires. If you do not ask us to delete your data by the end of the premium membership, your premium membership will become a basic membership. The information given above regarding the duration of the storage of basic member data then applies.

Please note that your data will initially only be blocked if the deletion is contrary to retention periods.

As part of the assertion of data subject rights, Masterpiece Fine Art stores the data that is necessary for the fulfillment or proof during the limitation period.

7. Right of Information

You have the right to request confirmation from Masterpiece as to whether we process personal data concerning you. In addition, you also have the right to information about this personal data, as well as information about the category of data that is stored, the purpose of processing, any recipients, the storage period and the rights of the data subject to which you are entitled.

Right to lodge a complaint with the supervisory authority

You have the right to lodge a complaint with a data protection authority. You can contact the data protection authority responsible for your place of residence or your state.

8. Cookies & Tracking

This online service uses cookies. In addition to the description of the individual cookies, we have also listed the purpose of use and other important information at this point.

Cookies are small text files that are sent when you visit a website and stored in the user’s browser. If the corresponding website is called up again, the user’s browser sends back the content of the cookies and thus enables the user to be recognized. We allow other companies to collect data from our users using advertising cookies or pixels. This enables us and third parties to display interest-based advertising to the users of our online offering, which is based on an analysis of their usage behavior (e.g. clicked advertising banners, visited sub-pages) overall and not limited to our online offering.

How can you delete cookies?

You can deactivate the storage of cookies via your browser settings and delete cookies that have already been saved at any time in your browser (see technical information). Please note, however, that this online offer may not work or only function to a limited extent without cookies.

Web Analytics

We need statistical information about the use of our online offer to make it more user-friendly, to measure reach, to be able to carry out market research and to display advertisements relevant to you. For this purpose, we work with various authorized service providers and use web analysis tools. The tools either do not use the user’s IP addresses at all or shorten them immediately after collection. The usage profiles created by the tools using analysis cookies or by evaluating the log files are not merged with personal data.

The providers of the tools process data in accordance with our instructions and not for their own purposes. The data protection declarations of the respective providers apply to these providers.

Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics uses cookies that are stored on your computer, tablet or smartphone and that enable an analysis of your use of the website. These are cookies from Google itself (Google Analytics cookies).

The information generated by these cookies about your use of the website, such as the pages visited, the time spent on them, the type of device and browser, and your approximate location (country or city), is transmitted to and processed by Google, also on servers in the United States. Masterpiece Fine Art uses Google Analytics 4, which does not log or store IP addresses. On behalf of Masterpiece Fine Art, Google uses this information to evaluate your use of the website, to compile reports on website activity, such as reports on performance based on demographic characteristics and interests, and to provide Masterpiece Fine Art with other services related to website and internet use.

Use of Google Ads Conversion Tracking

Masterpiece uses the online advertising program “Google Ads” and, as part of Google AdWords, conversion tracking. Google Conversion Tracking is an analysis service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). If you click on an advertisement placed by Google, a cookie for the conversion tracking is placed on your computer. These cookies lose their validity after 90 days. If you visit certain websites of our website and the cookie has not yet expired, Google and we can recognize that you clicked on the advertisement and were forwarded to this page. Every Google Ads customer receives a different cookie.

The information obtained using the conversion cookie is used to create conversion statistics for ads customers who have opted for conversion tracking. Here Masterpiece Fine Art finds out the total number of users who have clicked on their advertisement and have been forwarded to a page provided with a conversion tracking tag. However, you will not receive any information that can be used to personally identify users.

Use of Google Ads Remarketing Function

Masterpiece uses the online advertising program “Google Ads” and in this context conversion tracking (visit campaign evaluation). Google Conversion Tracking is an analysis service provided by Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Using this function, Masterpiece can target visitors to the website with advertising by displaying personalized, interest-based advertisements for visitors of Masterpiece Fine Art when they visit other websites in the Google display network or use the search function of Google or a partner. Google uses cookies to carry out the analysis of website use, which forms the basis for the creation of interest-based advertising. To do this, Google stores a small file with a sequence of numbers in the browsers of Masterpiece users. This sequence of numbers records the visits by Masterpiece and data on the use of Masterpiece. If users subsequently visit other websites in the Google display network or the search function of Google or a partner, Masterpiece Fine Art visitors will see advertisements that are highly likely to take account of previously accessed product and information areas.

Use of Facebook Custom Audiences

Masterpiece wants to present “interest-based advertising” on Facebook and limit the frequency with which certain advertisements are displayed. For this purpose, Masterpiece Fine Art uses the website custom audiences’ tool from Facebook and the Facebook pixel. The Facebook pixel is a Javascript code that sends the following data to Facebook Ireland Ltd, Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland (“Facebook”):

HTTP header information (including IP address, information about the web browser, page storage location, document, URL of the website or the respectively accessed page and user agent of the web browser as well as day and time of use).

Events (the user’s website visit to Masterpiece Fine Art, registration, purchasing). Pixel-specific data; this includes the pixel ID and Facebook cookie data, including your Facebook ID (these are used to link events to a specific Facebook advertising account and to associate them with a Facebook user).

Facebook uses the hashed user-specific Facebook ID (contained in the Facebook cookie) to automatically check whether the data transmitted by the Facebook pixel can be assigned to a Facebook user. If no Facebook cookie is stored in your browser, no classification into one of the “Custom Audience” user groups is made.

if the Facebook ID contained in the Facebook cookie can be assigned to a Facebook user, Facebook will assign this user to a “custom audience” based on the rules we have defined, provided the criteria applicable to this are met. We use the information received in this way to display ads on Facebook (“Facebook Ads”). However, ads are only displayed from a “Custom Audience” size of 20 different users – so no conclusions can be drawn about the properties of the individual users from the placement of the ads. The assignment to a “Custom Audience” takes place for a maximum of 180 days. This period starts again when you visit our website again and there is a conformity with the same “Custom Audience” rules.

Facebook can assign your visit to our website and your related activities to your Facebook user account. We cannot do this. We only receive statistical information from Facebook about the use of our website through Audience Insights.

Social Plugins

The integration of social plugins invariably leads to the providers of the plugins storing cookies.

To increase the protection of your data when visiting our online platform, the plugins can be integrated into the page.

Only when you activate the plugins will your internet browser or app establish a direct connection to the servers of the respective plugin provider.
